Marijuana vs. Alcohol; Alcohol is fine, pot is not.

Hypothetical situation (maybe not so hypothetical):

Let say you go to Breckenridge on vacation, buy some perfectly legal pot and smoke the hell out of it while you are there. Then, when you go back home, you find out that your job has decided to randomly drug test everyone. Obviously, you are gonna fail the drug test. The fate of your job, at this point, is going to be at the mercy of your company's drug policy but will your company still be able to legally prohibit penalize (terminate) you for smoking pot if you go to Colorado or Washington? Will you be able to sue for wrongful termination if you get fired for smoking pot that is perfectly legal in Colorado and Washington?

What do you guys think?

Obviously, I'm kidding with you. But I am kinda serious too. Up until yesterday, I could totally see your point that a company could fire you for failing a drug test because you had pot (THC) in your blood/piss. BUT NOW Colorado and Washington are saying that smoking a joint is as harmless AND AS LEGAL as drinking a beer.

How pissed would you be if your company fired you for drinking a beer on the weekend?

marijuana actually is addictive. research has shown that there are cannabanoid receptors in the brain. there are chemicals in the brain that are very similar to the cannabanoids in marijuana, these chemicals and their receptors have to do with calming and sleep. when you smoke a lot your brain stops producing these as much and if you quit smoking you would have trouble falling asleep.

Whether its legal or not, if they specified when you got the job that you could be fired for smoking pot, I do believe they can still fire you.

You may be right. I'm not a lawyer. I'm just trying to wrap my head around this whole thing. I think it's wrong that your company can fire you for doing something that is perfectly legal, on your own time, that doesn't affect your work performance.

Coche: Sure, alcohol is legal in Alabama. But pot is now legal in Colorado.

Turn it around if you want to. What if my hypothetical worker wasn't just visiting Colorado. What if he/she LIVED in Colorado. Do you still think it would be OK for the company to fire him/her?

Big Picture: How can you have a company policy AGAINST something that is perfectly legal? To me, it's like saying "hey, if you eat at McDonald's, we're gonna find out. And if we find traces of Big Mac in your piss, we're gonna fire you." Seems like an open door to a wrongful termination lawsuit to me.

i was thinking the same thing. i don't think that they can tell you that you can't do it at home, but they can still fire you if you come in intoxicated.

The laws regarding marijuana don't make sense, and never have.

Marijuana is considered a Schedule I drug by the US government. It is therefore listed as a drug with " a high probability for addiction/abuse, and NO medical value whatsoever". It is the government's highest drug classification.

What are some Schedule II drugs (which are ostensibly less dangerous)? Morphine, Oxycodone, RAW OPIUM, and cocaine!

So if I do enough cocaine, it might make me want to try...marijuana? Ridiculous.

Like I said I never touch the stuff, but we as a society have wasted far too much time and resources over the last 80 years chasing stoners.

My only stipulation about legalization would be having to take a piss test before qualifying for ANY public assistance. The taxpayers should not be paying your rent and buying your frozen burritos so you can spend all your cash on weed.
