How can I prove Driver who hit me was speeding?

I pulled out safely from a stop sign. I saw no cars in the near/immediate distance to my left.
Wham! I got hit with TREMENDOUS :spaz force in my front end! Should have been hit by driver side, Thank God that didn't happen! Speeder never braked, she swerved to the left towards sitting cars and then to the right and hit me with her front right corner...odd. German VW not as bad off as Japanese? Geo Metro
I need to know where I can get crash data for head on collisions with Geo Metros. :fon Or where can I go to pay for an independant person to assess damages...if there is such a thing. :dunno
This woman was NOT driving 35mph. She actually kept flying by an additional 3-4 car lengths :bump after she hit me with tremendous force. Both parties are okay. My car is totaled. :horse
I searched high and low for 2 months for a 3 cylinder, 5 speed two door hatch back. Had her for less than 2 weeks. I was sooo happy :D and proud :P with this adorable, :wub: excellent running car. The Ford dealership sold her to me for $350.00 cause they thought it had engine issues. :lol There was oil all over the air filter housing. I knew it was a $6.00 PCV valve and replaced it myself. :thumb
Gave her a thorough cleaning, stuck on some cool Metal Stickers :rocker drove her defensively
like I was on a motorcycle, :drivin was very careful and WHAM out of NOWHERE! :banghead

I've mostly driven LARGE gas guzzlers ( 66, 71, 72, 78 Lincolns, 61, 62 71, 72 Caddilacs), :banana I absolutely adored this tiny little Geo...sniffle. Now I'm afraid to buy another one cause I think I could have been crippled had she hit my door with the force she hit the front.

move on
buy another metro
and

stop at the stop signs , do not go until there are no cars coming .

Yeah, I know! I'm pretty cool about things but I just sat there dumb founded! It was as if though a meteor dropped out of the sky. I never saw her coming AND I LOOKED at her direction before I pulled out. I guess the signs are just saying I need to get my 59 Rambler Super on the road.

MWEB...I was stopped at the stop sign for quite some time. I didn't just pull out will nilly. This woman literally came out of nowhere and she was speeding. She never applied her brakes either, she had no control over her car. I think she was on a cell phone speeding to the light ahead of her.

if she never applied her brake , it may be that she was not expecting you to run the stop sign until after she had passed , she did take evasive maneuvers but
you were in her path and you did not evade , you did not even know she was there as per your own words

VWs can be very fast and agile , but they do not move at the speed of light .

even if she was speeding , you should have waited until she went by
this is your error , your mistake .

You can have the cops or an investigator pull the black box out of her vehicle, it will tell exactly how fast she was going. All vehicles made in the last few years have a black box

not enough info here to say

but
if the police report shows she jumped the stop sign ....
case closed
there will be no additional investigation
imho

VWs do not have a magic "black Box" that can be removed , there may be recorded data IF there was airbag deployment IF

I gotta agree here, theres been times where I look both ways and go to pull away, checking again see there was a car right there I completely missed. As positive i was beofre there was no car. I just missed it.

You are correct, the box can be read, not taken out. I didn't realize the airbag had to be deployed to read the date on the box.

I can't help you but I am very sorry and sad that this happened to you. :(

I can only think of a personal law suit. That seems to be the way things are solved in this country now. I know you are selling it but I'd like to see under the hood as to how far back the damage is. I know the radiator is gone, was wondering if the car could be saved. I straightened out the front frame members of the '96, got the lights straight and replaced the RF fender. Not perfect but a great car.

IMHO, if it were in your destiny, you could have been killed in any of the big cars you owned. Some of these events are not under our control and never will be. I've ridden a bicycle cross country 15 or so times and never thought I'd live over 40 years old. And no, I never got any help from the police when I was in an accident with a car.

I'll say prayers for you.

Once again, I DID NOT PULL OUT INFRONT OF THIS WOMAN'S PATH WITHOUT LOOKING IN HER DIRECTION DOWN THE STREET! THERE WAS NOBODY IN THE IMMEDIATE AREA. SHE CAME FLYING FROM OUT OF NOWHERE. I've already contacted an attorney. There are case laws on this matter in which the person that has already entered the intersection "safely" and was hit by a speeding vehicle was found blameless or partially to blame depending on the area of impact and/or circumstances.

Case in point

My surveillance tape clearly showed the driver was going over 50 miles per hour in a 30 zone, and my testimony (in three court appearances and a deposition) was that they were speeding up and then hit the horn instead of their brakes. The court concluded this was the cause of a collision they could have easily avoided through exercise of due care under the circumstances. The driver at the stop sign was cited for failure to yield, but the violation was dismissed because there was no evidence she had not property stopped and yielded to approaching traffic, as she and her passenger claimed. "
