I'm saying she could have braked, and, for all practical purposes, you wouldn't have known. If you watch any of those videos you'll see, all of those cars brake super fast...do you hear a lot of tire squeal or see a lot of skid marks?


You were adamant (yeah spell check fail) I was wrong about her car with ABS, I knew that was a 2000ish VW from the looks of it...which has ABS.


I don't know how else to tell you this, you were wrong. It doesn't matter though, replace the car and drive better from now on.


EDIT: You say you've never avoided a situation without brake squeal and skid marks? You also drive old cars with bad tires and bad brakes. A 2000ish VW has neither.

I don't know how else to tell you this, you were wrong. It doesn't matter though, replace the car and drive better from now on. Careful

OK, skid marks or not this person clearly did not do enough to avoid a car entering the street from a side street. Red VW can't prove she hit the brakes to avoid the accident and prove it by showing skid marks. If she was waiting in line and got out of it, did Red VW use turn signals? Clearly Red VW was either in the center lane and making a left turn OR illegally using the center lane to drive through to the signal. If NOT then she did not anticipate 59RamblerWithFins crossing the street from the right and thought she could make it past but clearly misjudged.

How clear is this? A long line of traffic, someone is kind and makes a space for you by stopping, traffic moves forward, you look both ways (especially to the left for oncoming traffic) and creep into the lane to cross the street between two cars and a red VW hits you. THAT IS CAREFUL.

The other drive could have 4 year old tires and worn pads. They could be ignoring the CEL - we do. Totally unfair to think the red VW was in good condition just because it looks nice.

As far as the law is concerned you are at fault. In my wreck (about a month ago) I hit the person doing what you were doing. I was going under the speed limit and they were trying to rush to work. They pulled out and there just was not enough time to stop.

Sorry but its looking like your going to have to take the blame. Its not always fair, but you have to yield.

NEW pictures of intersection at http://www.Evascar.weebly.com You can then click on the link "GeoMetro2 at top or bottom to see all the intersection pictures which show where my car was. YES, I was in the street. This is evidenced by where the first puddle of antifreeze is in the pictures. I was hit, pushed back off of the street. VW said she saw me pulling out. If she did see me, and lets just say I didn't enter the lane fully, how could she not have swerved to avoid me? Also, I WAS IN THE LANE, SHE SHOULD HAVE T-BONED me!!! She didn't. She swerved towards center lane towards the empty space (CAUSE I WAS IN THE LANE ALREADY) and then swerved back towards me to avoid the car infront of the empty space and hit me sending me back several yards. Speeders cause accidents. I did look and no one was nearby. I did look, it would have been stupid to pull out after I had been siting there for so long waiting for everythng to be perfect,

This is a diagram I drew of the accident scene. I was in the intersection already when I got hit. In Pennsylvania this matters. I'll find the law/statute by Monday for those that keep saying I was in the wrong.

Who says ABS don't leave skid marks? Fooey. first your 85% remark is null and void as that requires experience which MOST PEOPLE simple do not have. when they need to stop its 110% on the pedal. Period.
That's not entirely true either.

My Mercedes E-class, I can stand on the brake pedal, and it will not skid, nor chirp, whatsoever.

regardless of if she was speeding or not it looks to me like you should have stayed stopped at the stop sign by what your drawing shows. also... cars dont come from "nowhere"

Study the picture above....there is a bend...if someone is going 50 mph then they are flying around the corner and impact will occur within a few seconds after I entered the intersection. At the bend there is a green light...if she had green light and all the cars were lined up in the center then she came flying down the road...yes, PLEASE, study the picture above!

A guy I used to work with was driving his Ranger. He stopped at a stop light, light turned green so he proceeded to enter intersection. A company work van turned left in front of him. His van hit the left side of the Ranger at the fender bumper area. He pulled out the fender and drove to work. The guy in the van was cited. My buddy called the # the guy gave the cop for insurance and it was a wrong number. It took a week of calls to finally tract down the correct agent. My buddy's estimate for damages was $2100. Agent said he would give him $750 and not a penny more cause the agent said my buddy could have avoided the accident. The state trooper didn't think so but the agent did! :banghead :banghead The agent said he could sue them if he wanted to but legal fees would cost more than what he would get. So my buddy was pissed but took the $750. He got totally F'ed!

Eva, nice looking Rambler and I've read this whole thread and to me it looks like she was in a hurry and slipped out behind the truck with her foot to the floor and didn't have time to stop before she hit you. Her out would have been to swerve to the right and miss you all together. The phone must have distracted her from making this decision.

Most people must believe even though they have the right of way it's ok to just not avoid an accident. If an old man was crossing the street where he shouldn't and you were driving, would it be ok to hit him just because you have the right of way? No, it's the law you must take reasonable actions to avoid an accident! Good luck Eva! Oh and don't scrap your Metro let someone fix it if possible!

Rambler. As evident from your thinking the car was a 89, and many other things you have said, you simply do not understand the subject of the discussion beyond what you subjectively feel to be correct. Cars,or physics of collision are simply not your strong point.

So, by the counter arguments I hear if I am driving down the road and there are cars lined up on the left, I'm doing the speed limit, or not, and a car is crossing my path in front of me, has legally entered the intersection to turn but is being cautious, I have the right to hit it because it is not yielding. Wow.

Because by looking at the side impact of the front bumper on the Geo, seeing that the bumper was shoved to the right I was intending to go in front of the Geo. My other options being slow down to let the Geo cross my path, t-bone it or go to the right. I must have my left wheels on the yellow line (at least, or over it) and believe I am going to make it in front of the Geo.

Clearly, I expect to make it between the Geo and the parked cars, because if the black SUV had stopped for the Geo the space in front of it was created by cars ahead of it pulling forward. I could be two cars back thinking "Dumb*** black SUV! The cars are moving, LET'S GO!! well, I'm going" OR "I'm not waiting in line, this looks like a nice place to cut in. Because, again, the bumper was hit, not a t-bone, if I was going straight I'd t-bone the Geo because it is not yielding and I'm a demi-god who will not get ticketed... the Red VW had made a choice to go in front of the Geo.

My question to the police is was Red VW simply trying to jump ahead of the Geo and cut in line but misjudged. Possibly thinking the Geo was stopped to let Red VW in the space. Re-read nerys parking lot story.

Part II.
Let's assume, a Geo Metro leaves a dead stop (cautiously) and crosses a 8.5 foot wide roadway. How long would it take? At 6 mph it would take one (1) second. Let's say it takes 4 seconds if the Geo is being VERY careful and watching for traffic from the right that might be turning into the space created for you to turn left through. Three is more realistic, eh (release clutch (2), add gas (1), . If the Red VW is traveling at the speed limit, it would be 205 feet back at the start point. At 20'/car (2005 Land Rover is 190", Toyota Sienna 201" or 16.75') that places it 10 cars back. The Geo is 13.5' long.

If 60-0 mph is 151 feet then 35-0 is 88 feet, let's settle on 90 to stop. So if it takes 1 or 2 seconds to see the Geo it can stop in time. Even 3 seconds (200-150=50) and it will still hit the Geo. but under braking it would take longer than 1 second to cover 90 feet as the speed is diminishing.

From the moment of impact backwards, the Geo has been in the intersection 4 seconds and the VW had 200 feet to stop from 35 mph which would take 90 feet, in a straight line. If the Geo was 2 seconds, half way, into the intersection the Red VW had 100 feet to stop and only needed 90. And slowing from 100 feet or 5 cars back would take longer than 2 seconds as the speed was diminishing.

If the brakes were applied 5 cars back (when the Geo was 1/2 way through the intersection and moving at almost 6 mph) the accident would not have happened THE WAY IT DID. The Geo was moving at 6 mph yet the Red VW had time to maneuver left, in front of the Geo and take out the front bumper.

Just a thought....
