word of advice for when she goes to court. DO NOT SAY "it came out of nowhere". it shows that you werent paying attention. trust me it doesnt work.

Banshee you are wrong. Im a judge and whenever people use the excuse "it came out of nowhere", I believe them and they are not at all at fault. haha

I did.....

An F150 pulled out in front of me and I pushed that brake pedal as hard as I could, sure enough those tires locked up. They were less than 6 months old 155/r12s. I had newer front brakes and very little (if any) shoes left in the drums.

I don't know if this helps but my wreck was a side impact from a Toyota Camry or Corolla... the speed limit was 35mph for him, so I'd say he got down to 20mph by slamming his brakes and this was the result......

No you don't. You need to have a clue about the general evolution of car exteriors over decades. We're not talking a wrong year within a generation of a given car, we're not even talking something that's one generation apart. 2 generations and a decade apart. The cop really should have known better too, it's a pathetic(or accidental) mixup for someone who's job involves identifying suspect vehicles.

No you don't. You need to have a clue about the general evolution of car exteriors over decades.

How do you figure this is not what I just said? We aren't talking about the 60's, where car bodies changed every 2 years, and as pointed out the police officer who deals with various makes / models for a living didn't even know. As I said, and you more or less repeated, you would have to know a.) cars in general (pretty sure the evolution of exteriors over decades counts as "in general") and b.) VW cars specifically (pertaining to their *particular changes* over that time period) specifically to be pegging that car.

It is not something I would have picked out, having less than no interest in VW cars or even cars made in the last 10 years, to me they pretty much all look the same and I've worked in the car field previously. If I couldn't call it, I sure wouldn't expect someone with even less interest in it than I have to be able to.

I think the driver of the red jetta was aiming for that open spot.. not many drivers swerve, when in a panic stop situation.. or maybe thats just my favorite.... story?

As for proving that she's at fault or that she was speeding your best bet would be to have the driver of the vw say that she was on the brakes and for how long prior to impact she saw you? stopping form 35mph does not take too long especially not in an abs equipped vw? She was either speeding or not paying attention, you would just have to find a way to have her admit it. Read the police report carefully. Trying to prove it through physics is nearly impossible due to the angle and abs factors.

I hope that gives you some advice lol I don't think you can get her phone records but that would be convenient

AND!!!!!! due to the fact that the center lane was stopped 35mph is considered to be an unsafe speed for conditions, so if she admits to doing the speed limit its STILL her fault. Due to "UNSAFE SPEED FOR CONDITIONS"

I think you can actually request from your neighborhood police station for them to have a radar and display trailer setup there to monitor and slow down some of the speeding cars. My neighborhood does it all the time.

ALSO, look into it being a 1989 jetta. I got hit on my motorcycle by a car running a red light by a 90's LINCOLN. but on the police report it said BUICK. ends up the lincoln had no insurance, and the insurance company caught it before i even called them and the 1st thing they said to me over the phone is this policy has nothing to do with the accident. :-(. So i got a 8k bill and she got out of the accident without ever being cited for not having insurance. Which I don't think i would've wanted her to get a ticket but still its not fair..

No one makes a decent 155-12, why would you? It's an economy tire for an economy car. Any tire that lasts over 50K miles is as hard as a rock and offers little grip. Look at the treadwear #, anything over 400 is not a decent tire. I usually won't buy anything over 300, I like my cars to stop in the rain.

Basically, here's where everyone thinks i'm wrong. (just to be clear)

Cars can not emergency stop without smoke/squealing/tire marks. All cars look the same if they are the same brand, no matter the year. It's okay to pull out in front of someone.
