For all the great arguments, it's stealing. How do I know. The law says so. If the law said otherwise it wouldn't be. If you don't agree with the law, work to have it changed. If the artist posts it on a website and says take it, it's free. If they don't then you have no idea if the artist wants you to make an illegal copy. And if you get caught, like this person did; be preapred to suck it up and take it like a man (or woman in this case). It was their choice under the prevailing laws. Don't go crying that it's too high a fine (I agree, really it is) because they knew what they were doing in the first place. Your actions are also your responsibility. If you can't afford the repurcussions, then you shouldn't steal. |

No the law does not say its stealing. the law says its copyright infringement. (did you even TRY to look up the laws ???) its also by definition cruel and unusually which is constitutionally forbidden. Stop calling copyright infringement THEFT and STEALING. its not. and woodie I am sorry your wrong. Radio Stations DO NOT PAY ROYALTIES. Did you even READ the link you provided woodie? the radio part was simple for the SURVEY to determine the distribution of ASCAP/BMI funding to the labels. they don't actually PAY anything into ASCAP/BMI. OTHER PEOPLE who "play" music in the background (think radio playing at a restaurent or at an amusement park or in the elevator) now you know where "elevator" music comes from. its cheaper than the ascap/bmi fees. the SURVEY is simply used to determine distribution of the funds. SOME stations play songwriter fees (I don't know the history on that yet) but here is a good article on the royalties issue http://www.usatoday.com/money/media/2009-02-24-pay-to-play_N.htm PLEASE learn about what you speak. When will people learn. the law does not dictate to us. WE dictate the law. |

I couldn't agree more. We the people make the laws. The government is not a dictatorship ( although it seems this way at times). One thing I have no question about is this is not stealing. Not a little bit. Not at all. If I can hear it on the radio or watch it on tv for free it is no different in the slightest to download for free!

Only when WE do not do our jobs as citizens. Theft and stealing require the deprivation of property. since I am "COPYING" it leaving the original intact there absolutely positively can be no THEFT or STEALING. its called copyright infringement for a reason. Because THEFT and STEALING don't work. |

The mom is not a thief. She did not steal anything. Just because she downloaded a song you guys are calling her a thief. Using your same logic if she listened to the same song on the radio she would be a thief right? Don't be brainwashed by the record companies! Use your own brain and figure it out for your self. Listening to a song on the radio is free and ok but downloading the same song and listening to it is wrong and be punished severely and unjustly. It's the very same thing. No different whatsoever. |
