What I don't get is why is it ok to listen to a song on the radio for free but not downloading the same song for free. Is it not the same logically. If it's not then please tell me why it's different

Even if it was stealing. Logically it's the same. You didn't pay for it either way. Just a different medium.

correct and neither did the other end (the radio station)

In fact I don't even have a problem with TV shows being file shared if you leave the commercials intact (which no one does of course so thats a quazi moral issue for me but since they have NO morals about my access I don't feel bad either ie the way comcast just destroyed the analog band and replaced it NOT with digital but with ENCRYPTED digital so you have to use their BOXES which makes my sage tv server a paperweight so excuse me if I don't have much sympathy for them)

The point is in the eyes of the law as it CURRENTLY stands its 100% legal for a radio station to play ANYTHING without royalties.

its 100% legal for you to record it and 100% legal for you to SHARE IT.

with TV its the same way. its 100% legal for you to pay nothing and connect an antennae to your VCR its 100% legal to hit record and its 100% legal for you to SHARE that recording.

so why is it illegal to do EXACTLY the same thing but in a different electromagnetic medium.

because THAT IS the only difference between them.


and either way its NOT stealing since no property is taken. property "rights" are infringed. nothing more.

The current laws state this is basically theft of intellectual property. Copyrights are a legal compenent so it is technically a breach of law.

Whether we agree with the law or not; until we change said law, that's the rules we are supposed to play by. If everyone , artists included think this is incorrect, then by all means have the law changed but if not then we must expect there to be consequences for our actions.

As to Nerys previous posts, yes I have read the statutes and jurisprudence for both Canada and USA . ( I work in IT security so t's a job requirement to be informed)

You will find Canadian law is probably more lenient than American as our government imposed a tax on all blank media supposedly to compensate for illegal copying; but which most Canadians few as a license to copy. Essentialy - "Hey, the government is already making me pay for the doing illegal copying, so I have the right"

This issue has been argued by legal minds much more knowledgeable than ours (hey this isn't exactly a legal issues forum); so I would think they know the statutes a little more throughly.

Any time I see people arguing statutes like this it reminds me of those who spend their time screaming at American IRS about illegally taxing them and refusing to pay their taxes. They may even be right, but until they get a legal decision backing them; they will probably be getting a cell ajoining Wesley Snipes.

Let me correct it for you and you will find this corrected statement more properly matches our laws

Notice I removed basically and replaced theft with infringement

why remove basically? because there is no basically about it. IT IS infringement. in our law some infringement is permitted.

now here is where me and the law disagree. This should be PERMITTED infringement.

the argument is not if its a breach of law. Of that I agree it is (I also argue the law should be adjusted so it is not a breach but thats another topic)

the argument is this. Is it theft. Legally IT IS NOT.

no one has every been convicted of "theft" for downloading music.

they have been convicted of copyright infringement.

She was fined 1.5 million but they never expect her to pay it. It's only to set an example. Direct tv did this :shit back a few years ago with tv hackers. they sent extortion letters to people and demanded $3500 or they would be taken to court. Big companies with big $ can do whatever they want as long as the govt. is in their back pocket. You guys should be smart enough to figure this :shit out.

Kill someone nothing happens. Download a song woo hoo lets fry her ass. Make no sense to me. :banghead :banghead

I think some people truly believe that this is justice or the govt. is always looking out for your best interest. You're having fun which is cool, I like to have fun too but some people actually believe this!

I download music from big record people, but I pay for the little named peoples music...

Now a-days artist make their real money from doing shows. On the radio I heard that the evil girl known as "Bieber" makes 50,000 off every show. (Might have gotten the number wrong but it was around that) So what are the record sales and radio and downloads? Advertisements for the show.

When you go to a concert you expect to see a bit more than you hear. You go to see the costumes, get in the vibe, and if your have a chance to help pass around the joints. (never happened to me cuz I sit too far back but ya know)

I dont really see a problem with downloading the music b/c, as Nerys said the raido just plays it for free. The only difference between the radio and me is I choose when I hear what. I see where people would call downloading music stealing but when it comes right down to it I just dont care. I go to the concerts of the people I like to hear, buy their tshirts and other stuff. I support the music I like to hear.

That might have been a bit on the messy side I'm trying to multitask and its cold as a polar bear out here.

No the law does not say its stealing. the law says its copyright infringement. (did you even TRY to look up the laws ???)

Perhaps I should make my point of view more clear, as we seem to be arguing about two different topics. I did not look up the laws because I don't give a damn about the law. I don't live my life according to what someone else says I should do, and that includes law. I take a decision based upon morality, ethics, and whether or not anyone is hurt by my actions. I have a very strong sense of right and wrong and the golden rule. If something is legal or illegal is inconsequential with the exception of needing to consider if it's likely I would get into legal trouble which should be avoided for convenience. Government handouts like Welfare and Food stamps are legal, BUT THEY ARE WRONG and I would never participate.

Did you even READ the link you provided woodie? the radio part was simple for the SURVEY to determine the distribution of ASCAP/BMI funding to the labels.

they don't actually PAY anything into ASCAP/BMI.


Of course I read the link, especially the part that talks about the royalties that radio stations pay. Here's a simple four step "how to" from another website:


Keep a record of how much money to pay in licensing fees. Payments are required every quarter on average.


Deposit all money collected from the radio's station advertisement sales into a bank account. Discern how much to be paid to the licensing organizations.


Give the money set aside for licensing fees to the licensing organizations.


Record the amount of licensing fees paid by the radio station to the licensing organizations Ask the licensing organizations to send the radio station an invoice of royalty payments.

One thing I did miss is that there is a special exemption in the US only that gives radio stations a by on paying the performing artist, wasn't aware of that. They pay royalties only to the composer and publisher. Again the artist gets screwed.
