Honda getting sued for low gas mileage; Woman wins small-claims suit over Honda hybrid mpg

Honda advertised that the new civic would get 50 MPG. Lady only gets 30 MPG because of tech problems. She is bypassing lawyers and going for 10 grand in small claims court.

I hope she wins. I wish more people would do things like this. REMOVE the big bucks and the BS from the equation.

if you can state your case you should have a fair shot and this is a VERY commendable way to do it.

I am TIRED of the lawsuits where the lawyers get millions and the actual victums get NOTHING for all intents and purposes.

I certainly think it is appropriate in this case. Honda made claims that weren't fulfilled due to a technical defect in their technology. The best response would have been to make that right overall (i.e. replace the defective technology, the battery, with working technology, a new battery).

If they aren't going to do that, the results of the class action suit certainly do seem lacking, and the actions she has taken (while I doubt will result in 10k worth of damages) certainly are appropriate.

All we have so far is her word. I would like to see her paperwork proving that there is a defect in the car. I also would like to know her driving habits. Most people can not achieve the stated mileage due to their driving habits.
I am very interested in how the Judge looks at the evidence, especially Heather Peters.

More likely Honda will spend a ton of dough to prove her wrong (or settle). That way the case won't set a precedent that could be used by other consumers to make similar claims.

if i were honda if it went to trial id send a trained lawyer who just happens to not be licensed.

Well an average will stand no cha.nce against a lawyer. Im not saying she is wrong but bur isnt the mpg estimate from the govt?.....also a lot of times the commercials will show 1 model, but in the small wording mention the other model.... Now if she is right then I hope.she wins. 10k isnt too much at all. A lot of sue happy ppl would ask for a few hundred thousand. The ladies problem is that her car is the evidence. Honda gets their shot to test it. If they can prove a person could get 50ish mpgs they will be fine. Honda might not settle if they know they are right and use this as advertisement

In SC you can bring a lawyer with you to small claims court (and it is max $7500).

california. no lawyer and 10k max.


problem is she is a former lawyer and just let her license lapse. she has a huge advantage against a normal person.

That may not be such a problem. It means she probably has a better chance to have an effect than the average joe (josey). And she's trying to help others too which is pretty dang nice.

The only way to figure if it gets 50mpgs is to let members of gmf test drive it. Most of us are certified 50mpgers
