Honda getting sued for low gas mileage; Woman wins small-claims suit over Honda hybrid mpg

My wife has a 2005 Civic Hybrid. Driving it last summer in my monthly trip between DC and NJ I got around 49 mpg when drafting a big truck.

This past month, we barely got 37 mpg (this was after an oil change).

She says she only bough the car for the tax break.

What bothers me here is there is no mention of her bringing any evidence to court. Where is her paperwork from the dealership or any other garage stating her car is not functioning properly?
Today's journalists are horrible at reporting.

Wasn't this ajudicated in the small claims court? If so, now it's up to the plaintiff to get the money from Honda. How is she going to do this, stand in front of the corporate offices with a sign that reads "Honda owes me $9k, and they need to pay me NOW!!!"?

She will never see the money.
there are legal ways to get the money. Honda will pay. not necessarily now and i'm sure they will make it a pain.

What, you didn't go and demand to stand in the judge's chamber and review the 29 pages of evidence? You must be slipping ! :smackface

There is hope for you though, since I am sure the court records are public documents, you should be able to order a copy, feel free to contact the court and ask for a transcription of the stenographers documents, it should satisfy you that there was real evidence brought into the court to prove her case, and that she didn't just walk in, click her heels 3 times and wink and nod at the judge, say 'Puhhhhleasssseeeeeeeeeeeeee......' and have him order poor ol Honda to pay up 9k in cash to her :smackface :smackface :smackface

Back in the real world :ermm: this was more or less in line with what I expected to see happen, she lost on the punitive damages, although that hardly matters in this case as she was able to prove enough of the real damages to collect nearly to the limit of the small claims cap her damages not only in gas costs but in the battery pack replacement costs and the costs to set the car right (battery pack being the bulk of that).

I wonder if the other hybrid manufacturers will sit up and notice this or not.

Thats the way I feel if I win a new car in a contest. I would just sell it. My cars get "used" not pampered.
