The government put a tax on marijuana in 1937 because they didn't think an outright ban would be constitutional. The Marihuana Tax Act of 1937 was mostly pushed by several wealthy newspaper men who were afraid cheap hemp paper would hurt their timber interests, and was actually opposed by the American Medical Association. In order to possess marijuana, you had to get a tax stamp. But in order to get a tax stamp, you had to show up at a government office with marijuana. People who showed up with the marijuana necessary to get the stamp were arrested...for not having the stamp! The government only issued a very few stamps in the first place (nearly none prior to the mid-60s), essentially creating a de-facto ban. The Supreme Court finally caught on to this paradox in 1969, and ruled the marijuana tax violated a person's Fifth Amendment right against self-incrimination. By showing up with the marijuana to get the stamp necessary to legally possess it, you were forced to incriminate yourself by first openly breaking the law. It was shortly after this Supreme Court case, in 1971, that the government passed the Controlled Substances Act, which lumped marijuana in with cocaine, heroin, etc. It was a mistake then, and it is a mistake now. I am not saying marijuana is good, and I don't touch it. But it's prohibition has not had the intended effect. JMHO. Edited by Cobrajet25, Dec 2 2012, 05:26 AM.

Do you talk to a woman who is on her period? Against the bible. Do you wear clothes that use two or more different types of fiber? Against the bible. Ever cursed your parents for not letting you do something? Against the bible. Is your nose flat? Against the bible. Have you ever eaten fat? Against the bible. Ever beaten a slave so bad he dies? Against the bible. ... unless he/she gets up after 1 day. Then it's ok. It should be noted that most consequences for the above are either death or prohibit you entry to heaven. And here is a "funny" one: You can only get into heaven if you have intact testicles. Seems you can beat cancer but you'll burn forever because of it. *EDIT* I almost forgot my favorite one! Work on the sabbath? YOU SHALL BE PUT TO DEATH. |

References for the "proof texts" please. And then we can discuss this little snag called context. in the on topic part.... The Feds CLEARY should not be prosecuting the people that are growing marijuana legally. I would post links but I have to get back to raking the yard. |
