Got Rear-ended; Not in my Metro thank God

Went down to near Yosemite in Maraposa, Ca last weekend to pick up my son for summer vacation and had one nasty trip that was a good reminder of why I hate California so much. Was on Hwy 99 southbound around Ripon area in the fast lane of 3 lane, everyone doing close to 70 when all 3 lanes came to a stop (assuming for on ramp traffic) around 2:30pm, so wasn't even the really knarly traffic yet. Came to stop with a 25' cushion between me and car in front when I look in my rear view mirror and see a Nissan pathfinder dodge out of the middle lane at full speed. He was close enough at that point that I could see the drivers face as he is looking over his shoulder to see if he could merge back and dive through traffic. When he looked forward and seen I was still stopped, could actually see his eyes get big as he realized that he had no where to go, I punched it and moved maybe 20' trying to move between the concrete divider and car in front of me before he slammed into the back of my Subaru and I got launched in between them...he never even got on the brakes.

Guy tried to drive off, fortunately he couldn't because drivers front was caved into the tire, tire blown and steering bent. Took two hours sitting in 100 degree plus weather before finally got the car towed. Was a little worried because guy wasn't the registered owner of Pathfinder, his drivers license was expired and picture didn't exactly look like him, but did have insurance (of the Mexican persuasion, nothing against them, many of my friends are from Mexico, just the legal way). Good ol CHP didn't even want to touch that issue and told the guy he might want to take care of his license in the future, wouldn't even write him a ticket. Next thing I find out after looking his insurance company up online is that Infinity mainly serves the spanish community and even drivers with foreign license in California, Arizona, Texas and Florida...curiously all point of illegal entry into this country. Fortunately I have good insurance because so far this guy will not answer his phone to claims people.
Anyways, got lucky that I didn't have my son in the car and that I was driving the Subaru instead of the Metro or things would have been severely worse. Tow yard owner (great guy, spanish american) let me grab a light housing off a 2006 Chevy truck, flipped it upside down and wedged in the crater where I got hit, wired what was left of sockets up for basic signal/brake/park lights and taped into housing, went to walmart and got some plastic, cardboard and extra wide gorilla tape, covered the back window and used the cardboard to smooth over the crater and give it some form of aero to get home. If I left it there, they said they would total it, so after finding no suspension damage just all upper structure, drove it home 1300 miles with only one issue about Oregon border on I5, only one hinge was left on back hatch and I rolled window down right when I hit a big bump...hatch took a drift down the road. Nobody was behind me so wedged it in the car and got to my cousins house in Medford and we screwed the door in place and re-taped everything.

Glad you're okay Monza... Should check in with a doctor to be sure..

Its a good thing you were able to reposition your Subaru before impact. It;s a sixth sense honed from years of driving a Metro I bet.. :P

Those Subies are pretty strong cars!

Got checked at the ER because top of headrest got me in the low neck even though I was braced for it. Neck is swollen a little and burning down into shoulder right now, giving it 2 weeks to go away or I have to get an MRI.

Going to give it some more abuse and go down to Lewiston, Idaho tonight...one of my step-sons is getting married. I promised not to laugh evilly after he says "I do". :lol

I don't understand why the police did not issue the guy a ticket. He should be liable for all sorts of damages. His license was expired too.

Glad you're okay. Subarus are tough cars, used to own a 1997 Outback Wagon myself. I bet the guy can get a free college education, too. Unlike us American-born folks... :-/
